In the dispute over more spectators at the Games of the Football Bundesliga, the 1st FC Cologne has not succeeded in front of the Constitutional Court of the State of North Rhine-Westphalia.
The constitutional judges rejected the adoption of an interim injunction against the restriction to 10,000 spectators in football matches by the state of North Rhine-Westphalia. The decision fell out with four three votes, as it was in the evening in a message without mentioning a justification. This should be published at a later date (Az.: ASGH 20 / 22.VB-2).
The course before the Constitutional Court was a decision of the North Rhine-Westphalian Oberanverwaltungsgericht. The OVG had rejected an urgent application of Cologne against the Corona Protection Ordinance of the Cologne in the early evening.
The FC wanted to reach that already at the coming game against Eintracht Frankfurt this Saturday not only 10,000 but 25,000 spectators in which the arena may be allowed. The country’s decision to give the protection of the population in the Corona pandemic to a higher priority than the economic interests of the football clubs, was comprehensible, had argued the OVG.
Confederation and countries had decided on Wednesday that from 4 March nationwide national major events – to which the Bundesliga games are counted – should be geared to up to 25,000 fans (at a maximum utilization of 75 percent). From 20 March, all profound protective measures against the coronavirus are to fall.
